Hello all, a guy named dcace joined my forum and emailed me today to tell me about this place

He uses my images and even though I release it under the CC lic. hes req to give me credit and allow others to modify the work, he does neither
You may want to check there to make sure hes not using your work without permission. I have notified his isp ( he has no way to contact him through the site) no reply from his isp yet.

Yeah by putting art online you do risk these kinds of things.
Not much you can do either. I would be willing to guess the money you put into a lawsuit would not be profitable. There is nothing really protecting pixel art sprites.
Sorry this happened to you. I say find a hacker and shut em down.

Take the concern to his web host. Tell the web host that he's committing copyright infrindgement, show them the convos you've been having with him, and tell them that if they do not do something about it, you will consider a lawsuit. It doesn't really matter if you can't file one. And I'm sure the ToS of his web site provider has something in it about copyright infrindgement.

I did, they want me to file a dmca and fax it in :x im still trying to get a hold of him

DMCA? I am not familiar with the lingo. He might be purposefully avoiding your emails, d'yathink? That might be another thing to tell them. If you can't fax from home, I'm sure your local public library will have a fax machine you can use for a few cents.

TYVM sir! i think he asked me a long time ago if he could use them but I told him I released them under the CC lic so as long as he folled it that would be fine, apparently he ignored that :x

Thats the thing the music industry uses to sue people who steal their songs, its also the thing that keeps me from legally ripping my own DVD's for personal use :(

I did find your images available, I asked your permission to use them (about 6 months ago)
You gave it. I'm looking through my emails to find your reply right now.
However, if you feel that I should not be using your images I will remove them. I would not want to take advantage of your skill set.
If you would like credit for the images, I'm more then happy to build a credit page and put your info on it.
I try to double and triple check that the images I use are all available for open usage.

Its fine if you use the images AS LONG AS YOU FOLLOW THE CC LIC. which your not doing

I added the following:
"All of the above artwork is available under the http://creativecommons.org/licenses/by-nc-sa/2.5/ - Creative Commons License, which allows you to modify and use these images as long as you follow the license."
