I do know how colours work (at least to some degree) that's why I tried C64, also I seriously did not think about ptoings yus chunk until about halfway through I honestly did not.

well - i'm constantly inspired by other ppl - sometimes i start something and yes indeed it turns out to look VERY similiar to existing stuff - i don't say you were trying to rip or whatever but the shape and the expression (surely not the technique) are just too similiar to this already existing piece to be ignored.
other than that: even if the c64 palette was nice back in the day, it makes imo a lot more sense to learn how colors work together and make your own palettes than trying demo-stuff at this level of experience =)
@gil: No I really did notice halfway through, I don't why I made a bird, I just did... I realised that it was like yus chunk, that's all their is too it, it is THAT simple.

So you were working on something, and it "accidentally" turned into the same subject as one of the most famous c64 pieces on this site?
You were probably just inspired by the yus bird and made something similar, or you tried recreating something similar or whatever. I don't really care, but don't hit us with the "halfway through I noticed blablabla", it makes me feel like you're trying to hide something, and you're not I'm sure.
Besides all that, you get points for the effort, trying to work under those restrictions will be a good lesson for your pixel art.
It's an interesting start, but I think you need to work on composition. It seems you had a few ideas in mind and just started pixeling. Then, getting a different idea, went with it in the same work. Although the piece probably follows the restrictions I would try to utilize them and bend them to your will as much as possible; it'll make the overall effect much more pleasing.
It is an interesting concept but the thing about restrictions in modern pixelart isn't so much trying to mask the restrictions but embracing them for what they are and creating the best piece with a visible acknowledgment to those limitations. C64 has both an incredibly interesting palette and wonderfully tricky restrictions that the best pieces often are the ones that have the restrictions most visible. I'd check out some of helm's stuff and of course ptoing's for good examples of C64 with great visible restriction usage.
I know that's not incredibly concrete critiques, but perhaps just some ideas you can think about as you try to frame a more compositionally sound piece. Hope things go well, good luck!
