In this case the scene is just too generic, if you will, to really make a RIP call so this will be ignored. Colors are not owned by anyone therefore its also a grey area for the PJ staff. The values are identical therefore its likely that a palette was borrowed. If Frozennnn did in fact use Black's art for the colors then he should credit his art for it, its the honorable thing to do. He also does not have to because its too subjective a matter and there is nothing we can realllly do about it. It does appear to be the case to me but this is a personal opinion only, for which I have no proof. PJ always follows the 'benefit if the doubt' phylosophy to be as fair as possible. I hope Frozennnn and Black do not take this as a negative event but something for both parties to have a resolution.

You're right; I cannot say you copied (edited) my work just because you used the same colors. There's plenty of other reasons why I can say you might have edited the piece though:
If you look at the red circles, you'll notice that the arch in the clouds are the same. Yes, yours aren't dithered like mine, but the general shape and form of those colors in the clouds are the same.
If you look at the purple circles, you'll notice that the EXACT same line pattern is the same.
The yellow circles show another line pattern that is exactly the same.
The green circles show more patterns that are also the same (to be fair though, those are pretty common patterns).
So, based on the colors being the same,some patterns and some of the composition, I can reasonably suspect that you might have edited "Beach." The odds of some of the patterns being exactly the same, and the shape in the clouds are incredibly low.
And yes, you did add trees, grass and the like. However, that doesn't mean it's OK to edit someone's work. It's STILL editing, regaurdless of what you add to it.
So, I'd like to know why there's so many things that are exactly the same if you didn't edit it.

You seem to be missing what the problem is... the problem isn't about what inspired him to make this, but how he made it. I don't like it when people edit my work, or other people's work (most people don't like it in fact). That is the problem. He COULD have edited it, since as Adarias pointed out, there's a lot about it that's similar. Yes, the image as a whole is different, but it's the right half of it that isn't all that different.
And like I said, I don't really have a problem if all he did was just use the colors. If he did though, he should say he did so, so he can avoid accusations of editing someone else's work in a case like this (there's also just common courtesy).
I already mentioned in my first comment that I awknowlege that it's possible he just used the colors. But if you compare the two pieces, it's very probable that he could have edited it.
I honestly have no idea why you're making this out to be something petty. This is something that this site is strongly against, and takes pretty seriously.
You deserve so much credit for inspiring this young pixel artist blackbeltdude. In fact, an award is in order for your amazing original beach art because it is such an original piece of work that I never knew could exist before you came along. Clearly your originality in choosing these colors and such captivating composition decisions warrants a footnote in any pixelart by an artist picking a similar theme.
When, if I do, begin a new pixel art with these colors and it has something to do with beaches, I will make sure to mention you as the inspiration for such work.
Look, I'm not going off on the guy or attacking him. My eyes aren't glowing red, and I'm not foaming at the mouth, or even "pissed." But like Adarias said, the colors are EXACTLY the same. And like he also mentioned, the composition and patterns are also very similar.
If all he used were the colors, OK fine, but since he's using the colors I used for the same concept, it would be nice to have some credit given. If it's an edit, then he shouldn't have it uploaded period. Whenever someone posts sprites that are edited from ripped images, people cry murder. And that's fine, since this site isn't about editing other people's work. I don't get why you guys think Frozennnn is the exception to this rule, Mandarb and thecommontask. If he did edit my work, he shouldn't be posting it.
If you guys haven't noticed, this isn't Deviant Art. You don't sign away your rights to your work when you sign up here to post your stuff. You notice the "Report Problem" box on the right? If someone "barrows" someone's work on here, then you can do something to prevent them from posting it (here at least).
And just for the record, if I post commission work (like others around here have) then I get an OK from the client first. :P
Look, I don't even think Frozennnn even knew what he was doing was wrong (if he did edit my work). He's clearly new to this, and he's made a pretty common mistake. But it should be called out so it can be corrected.
Not everybody has the same skill level as everybody else. This is a "public" website. It's FREE, it's not exclusive. When/if you post your work here you basically are giving it to the public and you can do nothing to prevent them from 'borrowing' colors, layouts, etc. How about being flattered instead of insulted?
Also, if I commissioned somebody to do some work for me I'd be pissed if they posted it on a public site such as this (as it being borrowed is almost a given)
Everybody just take a chill-pill, loosen your sphincters, and relax. It's attacks like this that give places like this a bad name.
the colors are identical, the patterning similar, even the composition is, and the whole thing generally stinks of unoriginality. there's no point in aking because a quick check in a compiler shows that the rgb values are directly lifted.
My concern here though is less about direct editing as it is wondering which other aspects are also taken from other people.
Also, why on earth are the frames misaligned? You even have a big black band where you can see them falling off each other.
It's one thing to make a modest animation, it's entirely another not to care enough to use your own colors or properly present it.
It is just as possible that this dude created it without any concern for your pixelart "Beach". Wouldn't it be nice if you just asked him instead of going off on how unfair it is to the artist and client?
The palette may be similar but it's effing pixelart, colors are there to use just like outside of the computer. Should eight year olds fight over someone using the same red crayon in eachothers drawings? I think this piece is entirely different, nothign close to an edit. The idea of ownership with this format is very grey when posting just happen here and there on such forums. If you are concerned over this then protect your images more carefully or just don't show them.
You know, if you're going to use the my colors from my "Beach" pixel art in my gallery, you really outta say so... Because it honestly looks like to me that you could have just edited the backdrop from that. I realize the water is just made up of lines, but its very possible that you still could have edited it. If you did, I'd like you to remove it (and the one that isn't animated) from your gallery, because it took me a good while to finish for the client (who also would not like to see it edited, I'm sure).
i think that the "over-all hopping" is partially caused by "bad frame placement" or something... i mean, notice the black bars on the right and bottom? the whole image moves down - right - up - left and it starts again.
Frozennn - the motion of the trees is quite nice (just the leaves, try to stabilze the rest of the motion (the leaves and water would be the only thing "moving") For example the mountains/sky simply wouldn't "shift" like that. Nor would the body of water, just the up-close water, etc.
Stop the over-all "hopping" and this would be much improved!
The animation is terrible, but the picture is fairly nice. Try to focus on one thing till it looks good, and then start on the next part, so its not so overwhelming.
