Well many games use the same beholder, for instance Castle Crashers, and Epic Battle Fantasy, many games, i'm sure it in specific has no copyright.

Not bad, though I have to wonder if it's a legal issue to sell a game with a monster that's claimed as a "product identity" by wizards of the coast- link I don't actually know if it is or not, but I'd be interested in knowing how this sort of thing works.
