@Bunlee: When I suspect someone of using one of my palettes all I have to do is paste the original and theirs beside eachother in photoshop and check the hex codes. If they match up then I know they stole it haha :). There is absolutely no chance that someone would 'by chance' happen to choose the exact same hex codes for a sequence of colours.
As for what I can do about it, I do not believe there is any specific legal action I could take..I doubt I would even if there was, but usually if the person is reasonable, they will fess up and change the colours for you. However if the person is -not- reasonable I usually go over their heads to the owner of whatever site they have placed the image on.
I've gotten in a fare few arguments over wether palette stealing is okay or not. A lot of ppl are of the mind that 'its just colours and you cant (c) colours'. They are right as far as i know in that you can not (c) palettes, but they are not 'just' colours. A palette can make or break a peice.
I just have some questions on the topics about STEALING palettes. Of course stealing the art works without giving credit are not allowed anyway. But about the color palettes... 1. Is there any easy way to check an image is using the same palettes as yours or not? 2. Can you do anything about it when someone did used it?
There is a difference between a dollmaker and a doll. A dollmaker is when you drag and drop PREMADE peices to create something. A Doll is when you take a premade -body- and draw on it yourself.
Also I allow people to edit my work because when they do so I STILL receive credit. When people use my palettes they are STEALING from me b/c they do -not- credit me.
